ORDER

This petition has been filed seeking for a direction to the respondents 1 to 3 to take appropriate action to get the petitioner's property documents from the 4th and 5th respondents, based on the representation dated 08.09.2021 within stipulated time.

The learned counsel appearing for the petitioner submitted that the petitioner is a senior citizen mother, who has been subjected to physical abuse by her own daughters, who are arrayed as 4th and 5th respondents. It was further submitted that respondents 4 and 5 had forcibly taken away the original title deeds pertaining to the petitioner's properties. In this regard, the petitioner submitted a representation dated 08.09.2021 to the respondent police seeking appropriate action. However, according to the learned counsel, no action has been taken on the said representation. Aggrieved by such inaction, the petitioner has approached this Court by filing the present petition.

3. The learned Government Advocate appearing for the respondent police on instructions submitted that no such representation has been received sofar. 2/4

4. Heard the learned counsel on either sides and carefully perused the materials placed before this Court. Considering the nature of the order proposed to be passed in this writ petition, notice to them is dispensed with.

Considering the facts and circumstances of the case, this Court directs the petitioner to submit a fresh representation to the respondent police setting out her grievances and the relief sought in the present petition, forthwith. On receipt of the same, the third respondent police is directed to consider the same and conduct a discreet enquiry in this regard, after issuing summons to the petitioner and the private respondents and also other concerned parties, under Section 64 of the BNSS, and facilitate return of the petitioner's property documents such as title deeds to the petitioner, within a period of four weeks from the date of receipt of a copy of this order.
