The Criminal Miscellaneous Petitions filed under Section 528 BNSS, praying to modify the condition No.10(i) imposed in Crl.M.P.Nos.2132 & 2167 of 2024 in Crl.A. (MD)Nos.139 & 144 of 2024 dated 07.04.2025.
COMMON ORDER The petitioners have filed these petitions to modify the condition No.10(i) imposed by this Court in Crl.M.P.Nos.2132 & 2167 of 2024 in Crl.A.(MD)Nos.139 & 144 of 2024 dated 07.04.2025.
2.The learned counsel appearing for the petitioners submits that the sureties, who are Government Staff, are afraid of filing undertaking affidavit before the respondent Police that it would affect their service condition and therefore, the petitioners filed these petitions to modify the said condition. The learned counsel further submits that the sureties are prepared to ensure the good conduct of the accused. However, the condition directing them to file an affidavit to ensure the good conduct of the accused maybe modified.
3.This Court has considered the submission made by the learned counsel appearing for the petitioners.
4.Though this Court has granted bail to the petitioners on 07.04.2025, the petitioners could not come out on bail, in view of the condition imposed in No.10(i) by this Court in Crl.M.P.Nos.2132 & 2167 of 2024 in Crl.A.(MD)Nos.139 & 144 of 2/4
2024 dated 07.04.2025. Therefore, the said condition alone is modified and the sureties shall ensure the good conduct of the accused and they shall not file any affidavit to that effect. However, they shall ensure that the petitioners herein are not involved in any other offence, in future. The other conditions imposed in Crl.M.P.Nos.2132 & 2167 of 2024 in Crl.A.(MD)Nos.139 & 144 of 2024 dated 07.04.2025, shall remain unaltered. Accordingly, these criminal miscellaneous petitions are ordered.
