ORDER

The petitioner herein was appointed as Pump Fixer in the 4th respondent-Panchayat Union and was regularised in the said post. Finally, the petitioner retired from service as Skilled Assistant on 29.06.2012. However, his pensionary benefits are not settled as on date, though provisional pension is being paid. Hence, the petitioner approached this Court by filing the present writ petition seeking for payment of the pensionary benefits.

2. When the matter is taken up for consideration today, it is brought to the notice of this Court by the learned Government Advocate that the pensionary benefits of the petitioner could not be settled for want of furnishing of the PAN card details of the petitioner and it is only now the

petitioner has furnished the same and accordingly, a proposal was submitted by the 4th respondent to the 1st respondent through letter dated 19.03.2024 proposing for release of all the pensionary benefits payable to the petitioner and further, submitted that the same would be paid to the petitioner within a period of four weeks hereafter. A copy of the said proposal dated 19.03.2024 is also furnished to the learned counsel for the petitioner.

In view of the above, this Court does not see any reason to adjudicate the matter on merits and accordingly, this Writ Petition is disposed of directing Respondent No.1 to pass appropriate orders on the proposal submitted by Respondent No.4 dated 19.03.2024 and release all the pensionary benefits payable to the petitioner within a period of four weeks from the date of receipt of a copy of this order. If the petitioner is aggrieved by such fixation of pension, it is open for the petitioner to take appropriate steps in accordance with law. No costs.
