ORDER

The writ petition has been filed challenging the order passed by the respondent No.3 dated 01.06.2022, thereby rejected the representations submitted by the petitioner seeking, cancelling the disbursal of death benefit in favour of the respondent No.4.

2. The petitioner and the respondent No.4 are brothers, their father Mariyappan, who was an agriculturalist died on 21.10.2018, leaving behind the petitioner and the respondent No.4 as his legal heirs.

3. There is a scheme for funeral expenses/compensation for the agriculturalist under the Chief Minister's Uzhavar Pathukappu Thittam,

2011, for natural death and funeral expenses/compensation. When the petitioner applied for the same, he was informed that the respondent No. 4, already applied and the amount of Rs.22,500/- (Rupees Twenty Two Thousand and Five Hundred) was disbursed in the favour of the respondent No.4.

The petitioner submitted a representation to cancel the disbursal of death-cum-funeral expenses/compensation which was already disbursed in favour of respondent No.4, on the ground that the respondent No.4 had shown the respondent Nos.6 & 7 as also legal heirs of the deceased Mariyappan and obtained a No Objection Certificate from them for disbursal of the death-cum-funeral expenses/compensation.

The respondent No.4, was the one of the members under the Chief Minister's Uzhavar Pathukappu Thittam, 2011, there is absolutely no implementation of death-cum-funeral expenses/compensation to the member who applied for the same. If at all, any grievance offered to the respondent No.4, in respect of the disbursal of the compensation, the

petitioner can very well approach the Civil Court for his share.

6. Therefore, the representations submitted by the petitioner was rightly rejected by the respondent No.3 and this Court finds no infirmity or illegality in the order passed by the respondent No.3.

7. With the above observations and directions, this writ petition is liable to be dismissed and is accordingly dismissed. No costs. 24.01.2025 NCC : Yes/No Index : Yes/No Internet : Yes nst
