ORDER

This petition has been filed seeking for a direction to the 2nd respondent to consider the petitioner's representation dated 23.03.2026 and take suitable action.

2. The learned counsel appearing for the petitioner submitted that the proposed accused had allegedly defrauded the petitioner of a sum of Rs. 15,00,000/-. In this regard, the petitioner had lodged a complaint with the respondent police. However, the same is not considered and hence, this petition came to be filed.

3. The learned Government Advocate appearing for the respondent police, on instructions, submitted that upon receipt of the complaint from the petitioner, summons were duly issued to both parties and a discreet enquiry was conducted. During the course of the enquiry, the proposed accused appeared before the respondent police and gave a written undertaking to settle the entire amount on or before 05.06.2025. In view of the said undertaking, the enquiry was closed.

4. In response, the learned counsel appearing for the petitioner submitted that, although the proposed accused had furnished a written undertaking to settle the amount within the stipulated time, he has failed to honour the same and the amount remains unpaid till date.

5. Heard the learned counsel on either sides and carefully perused the materials placed before this Court.

6. Considering the facts and circumstances of this case, the second respondent police is directed to reopen the petitioner's representation dated 23.03.2026, and conduct a discreet enquiry in this regard, after issuing summons to the petitioner and the private respondent and also other concerned parties, under Section 64 of the BNSS, and conclude the same, after affording an opportunity of hearing to them, within a period of four weeks from the date of receipt of a copy of this order.
