PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondent to declare as to why the petitioners question-cum-answer booklet pertaining to Register No. 0501050095 was "deemed not fit for valuation" in main written examination held on 25.02.2023 for the Tamil Nadu Public Service Commission Combined Civil Services Examination - II (Non-Interview Posts). ORDER
The instant writ petition has been filed by an aspirant, who applied to the post of Combined Civil Services Examination (Grade-II Services/Group-II A Services), seeking a mandamus as against the respondent to declare as to why the petitioner's question-cum-answer booklet was "deemed not fit for valuation" in the main written examination held on 25.02.2023. 2.The petitioner having cleared the preliminary examination had appeared for the final examination on 25.02.2023. However, when results were published on 09.04.2024, as against the name of the petitioner it was mentioned as (deemed not fit for valuation). Though the petitioner made an attempt to seek the reason for the invalidation, there was no response from TNPSC. Hence, the present writ petition has been filed.
3.The Deputy Secretary of Tamil Nadu Public Service Commission has filed a counter, paragraph No.5 and 6 are extracted as follows:- "5.It is respectfully submitted that, with respect to main prayer of the petitioner candidate to disclose the reason for 'deemed not fit for valuation', it is humbly submitted that while scrutinising the 1st page of Question cum Answer Booklet for Paper-II (General Studies), it is found that the petitioner candidate Thiru.P.Sendrayan bearing Register No.0501050095 2/5
had failed to sign in both designated columns provided. 6.It is respectfully submitted that para 17(F)(i)(j) of the 'Instructions to Applicants' states as follows under hearing 'Invalidation of Answer Booklet":- "Answer Booklet for Main Written Examination (Descriptive Type) is not signed by the candidate at all designated places"
Further, Para 17(C)(vi) states as follows:- "If an answer booklet of a candidate for one paper is declared deemed not fit for valuation, the answer booklets of the candidate for the remaining papers will also be treated as invalid/not subjected for evaluation"
In lines with the above-mentioned Para of the 'Instructions to Applicants', the Question cum Answer booklet of the petitioner candidate has been invalidated."
4.In view of the counter, it is clear that the petitioner having not signed in both the designated columns in the main examination, the petitioner's booklet has been invalidated, as per the instructions issued to the applicants. Since the request of the petitioner seeking a declaration has been complied with, no further orders are called for.
5.Accordingly, this writ petition stands closed. No costs. 01.10.2024 3/5
