Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondent to grant patta for the properties in Survey No.23/24 an extent of 5 Cents and Survey No. 23/25 an extent of 4 cents in Keela Vellakkal Village, Veerakeralampudur Taluk, Tenkasi District, by considering the petitioner's representation, dated 07.05.2025.

ORDER

The petitioner herein seeks a direction to the respondent to issue patta for the properties in Survey No.23/24 with an extent of 5 Cents and Survey No.23/25 with an extent of 4 cents in Keela Vellakkal Village, Veerakeralampudur Taluk, Tenkasi District, by considering his representation, dated 07.05.2025.

2. According to the petitioner, the subject property was purchased by his father - Sankaran under a registered sale deed, dated 12.08.1965, from one Samiyathevar, S/o.Muthuthevar. The petitioner's father died in the year 2014 and his mother - Lakshmi died in the year 2020. Therefore, as on today, the petitioner and his brother - Duraisamy and sister - Saraswathi are entitled to the estate of the petitioner's father. Therefore, the petitioner submitted a representation to the respondent on 07.05.2025, seeking issuance of patta in the name of the petitioner and his surviving siblings. The same has not been considered. Hence, he has come before this Court.

3. Additional Government Pleader, who takes notice for the respondent, would submit that the revenue records stand in the name of Muthuthevar and Samiyathevar and a civil suit filed by the petitioner's father against his brother's legal heirs in O.S.No.520 of 2007 on the file of Principal

District Munsif, Tenkasi, was dismissed and a further appeal in A.S.No.56 of 2011 on the file of Sub-Court, Tenkasi, was also dismissed, as abated, after the death of petitioner's father.

4. From the submissions made by the learned Additional Government Pleader, it appears that the revenue documents still stand in the name of the vendor of petitioner's father. The nature of the suit filed by the petitioner's father in O.S.No.520 of 2007 is not clear.

In these circumstances, without expressing any opinion on the merits of the matter, this Court is inclined to direct the respondent to consider the representation of the petitioner, dated 07.05.2025, and communicate the decision thereon to the petitioner within a period of eight weeks from the date of receipt of copy of this order.

6. Accordingly, the Writ Petition stands disposed of. No costs. 04.07.2025 NCC :
