ORDER : The Court made the following order :- The petitioner/Sole Accused, apprehending arrest at the hands of the respondent Police for the alleged offence punishable under Sections 379 I.P.C and 21

(1) of Mines and Minerals (Development and Regulations) Act, in Crime No.687 of 2023 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner has found in illegal transportation of 1⁄4 unit river sand through his vehicle without any valid permission and license and the same was seized by the respondent Police. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent and is no way connected in this case.

4. The learned Government Advocate (Crl. Side) would submit that the petitioner is having one previous case in similar nature. The earlier anticipatory bail application was dismissed by this Court dated 09.06.2023.

5. Considering the fact that there is no chage of circumstances and one previous case is pending against the petitioner, which is in similar nature, this Court is not inclined to grant anticipatory bail to the petitioner.
