Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the second respondent to restore the Petitioner's old age pension sanction in Na.Ka.No.9474/12/D3. Dated 22.06.2012 with effect from June 2022 by considering the Petitioner's representation dated 15.07.2022. For Petitioner :Mr.K.K.Samy For Respondents :Mr.C.Satheesh Government Advocate

ORDER

The Petitioner has filed this Writ Petition seeking a direction to the second respondent to restore the Petitioner's old age pension sanction in

Na.Ka.No.9474/12/D3. Dated 22.06.2012 with effect from June 2022 by considering the Petitioner's representation, dated 15.07.2022. 2.Heard the learned counsel appearing on either side and perused the materials placed before this Court.

3.The case of the Petitioner is that he was granted with old age pension, as he did not have male child to take care of him and his wife is aged about 65 years, affected by heart ailments. There is no other person to take cae of them. The second respondent had sanctioned the old age pension with effect from 1.6.2012 and the same was paid to him till June 2022 vide order made in Na.Ka.NO.9474/12/D3, dated 22.06.2012. All of a sudden, the said pension was not disbursed to the credit of his bank account from June 2022. Hence the Petitioner has approached the second respondent with a request to sanction the old age pension, who in turn had stated that some amount has been deposited in his bank account by selling the lands and hence he was not eligible to get the old age pension.

4.The learned counsel for the Petitioner submits that the Petitioner had sold his house in which he was residing and has given her daughter in marriage and now residing in a rented house with the help of the old age pension and prays for considering the same, as he is also at the

verge of losing his eye-sight. He would further submit that the above said house was sold ten years back 5.Considering the above facts and circumstances, this Writ Petition is disposed of with a direction to the second respondent to consider the request of the Petitioner for grant of old age pension by considering his representation, dated 15.7.2022 and pass appropriate orders in accordance with law,as the scheme is a benevolent one ment for old persons, within a period of four weeks from the date of receipt of a copy of this order.

6.With the above direction, the Writ petition stands disposed of. No costs.
