Prayer: Writ Petition filed under Article 226 of Constitution of India, for issuance of a Writ of Mandamus to direct respondents to take necessary action for violating the Advocate code of conduct committed by the 3rd respondent based on the petitioner's representation dated 05.06.2025. ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The relief sought for in the present writ petition is to direct respondents to take necessary action for violating the Advocate code of conduct committed by the 3rd respondent based on the petitioner's representation dated 05.06.2025.

2. The petitioners have already sent a complaint to the bar counsel of the Bar Council of Tamil Nadu and Puducherry for initiation of action against the 3rd respondent for the alleged mis-conduct. Soon after, sending the complaint the present writ petition has been instituted. Such a practice cannot be encouraged by the Court. Authorities must be given reasonable time for the purpose of scrutinizing the complaint received by them. The 2/4

Bar Counsel is dealing with complaints across the Tamil Nadu and Puducherry and therefore, they require some time to look into the complaint for initiation of all further actions. However, there should not be any undue delay in dealing with such complaints relating to mis-conduct allegedly committed by the lawyers.

3. Since the petitioners have already sent a complaint to the Bar Council of Tamil Nadu and Puducherry , the 1st respondent is directed to look into the complaint and take all appropriate actions by following the procedures as contemplated under the Act and Rules.

4. The writ petition is disposed of with the above observations. No costs.
