PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the respondents 1 and 2 to direct the respondents 3 and 4 not to harass the petitioner by interfering in the matrimonial dispute between the petitioner and the 5th respondent.

For Petitioner : Mr.SP.Vijay Nivas For R1 to R4 : Mr.SS.Madhavan Government Advocate (Crl.side) O RDER This petition is filed seeking for a direction to the respondent No.3 police not to harass the petitioner under the guise of enquiry by interfering in the matrimonial dispute between the petitioner and the respondent No.5. 2.It is submitted by the learned counsel for the petitioner that the petitioner and the respondent No.5 being wife and husband are not getting along well on account of various issues. The respondent No.5 stated to have filed a complaint against the petitioner, basing on which the police have been harassing the petitioner. It is also submitted that earlier a case has been registered against the petitioner on a complaint given by the respondent No.5 and similarly, on a 2/5

complaint given by the petitioner herein, a case has been registered against the respondent No.5 and both the crimes have been quashed by this Court on filing of a compromise memo and subsequently, again the respondent No.5 has started to file complaints.

3.The learned Government Advocate (Crl.side) submits that on a representation given by the petitioner, CSR.No.G2/15030 has been registered and during the course of enquiry, the petitioner appeared before the respondent Nos.1 to 4 police and reported that he will take steps to see that the dispute between the petitioner and the respondent No.5 will be resolved by filing a petition in the appropriate family Court. Accordingly, the representation given by the respondent No.5 is closed and there is no petition pending against the petitioner and subsequent to the closure of the earlier representation given by the respondent No.5, the police have never called the petitioner and the allegations levelled against the petitioner are incorrect and false. 4.Once the learned Government Advocate (Crl.side) has recorded that there is no representation pending before the police against the petitioner, no further 3/5

orders are required to be passed in this petition and accordingly, this Petition is closed.
