Pleased to allow this Civil Miscellaneous Appeal by dismissing the order and decree dated 02.03.2021 passed in M.C.O.P.No. 65 of 2013 by enhancing compensation amount of Rs.10,00,000/- on the file of the Motor Accidents Claims Tribunal, Pudukkottai (Additional District Court, Pudukkottai).

ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.K.BAALASUNDHARAM, Advocate for the petitioner, the court made the following order:- This petition has been filed to exempt the petitioners from paying Rs.8,123/- towards the court fee after deducting Rs.1,250/-.

2. The learned counsel for the petitioners would submit that the petitioners are financially indigent and that they are unable to https://hcservices.ecourts.gov.in/hcservices/ 1/2

CMP(MD) No.8501 of 2021 mobilise the entire court fee for the appeal filed for enhancement of the claim amount. With great difficulty, the petitioners have paid a sum of Rs.1,250/- and they are unable to raise a sum of Rs.8,123/- towards the court fee. The learned counsel would further submit that the petitioners may be exempted from paying Rs.8,123/- after deducting Rs.1,250/- for the present appeal.

3. This petition is ordered on condition that the petitioners undertake to pay the balance court fee, in case if they succeed in the appeal.
