For Respondent : A.Robinson, (in both petitions) Government Advocate (Crl.Side) PETITIONS FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C COMMON PRAYER :- For Anticipatory bail in Crime No.91 of 2019 on the file of the respondent Police COMMON ORDER : The Court Made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 406 and 420 of IPC, in Crime No.91 of 2019, seek anticipatory bail. 1/3
2.Heard the learned counsel for the petitioners and the learned Government Advocate (Crl. Side) for the respondent. 3.The petitioners are figuring as accused Nos.2 and 3 in Crime No.91 of 2019, on the file of the respondent. It is a case of job racketing. The petitioners are said to have received a sum of Rs.2,59,000/- from the victims. The petitioners through their counsel undertake to deposit the said amount to the credit of Crime No.91 of 2019 in question and they also seeks two months time to deposit the same.
4.In view of the offer made by the petitioners, this Court is inclined to grant relief to the petitioners. However, the petitioners are directed to appear before the respondent police daily at 10.30 a.m., for a period of two weeks and thereafter, the petitioners shall appear before the respondent as and when required. 5.Subject to the above said condition, this Court is inclined to grant anticipatory bail to the petitioners. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Eranial, Kanyakumari District and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for a like sum to the satisfaction of the learned Magistrate concerned and the petitioners shall appear before the respondent police as mentioned above.
6.The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.
