O R D E R

The present Writ Petition is filed for issuance of a Writ of Mandamus directing the first respondent to expeditiously dispose of the petitioner's Appeal Petition dated 24.01.2019, which was filed for cancellation of the patta and restoration of the same in the name of the petitioner's grandfather in respect of the properties comprised in Survey Nos.13/10B, 13/10C, 13/10D and 13/10F, situated at Pullaneri Village, Usilampatti Taluk, Madurai District and consequently directing the second respondent not to grant police protection for fencing the said properties till the disposal of the said Appeal Petition, within a time frame to be stipulated by this Court.

2. The third respondent had already filed a Writ Petition in W.P.Crl. (MD) No.530 of 2026, inter alia, praying for adequate police protection to fence the aforesaid properties. This Court, vide order dated 03.02.2026, Page No. 2 of 5

directed the respondents therein to consider the said request and pass appropriate orders within a period of four weeks. Now, the present Writ Petition is filed by the fourth respondent in the earlier Writ Petition in W.P.Crl.(MD) No.530 of 2026. The prayer in the present Writ Petition is to direct the first respondent to dispose of the appeal and consequently cancel the patta and restore the same in the name of the petitioner's grandfather and also not to grant any police protection for fencing the properties.

The contention of the petitioner is that when the appeal is pending, the third respondent shall not fence the property and the second respondent shall not provide police protection for fencing the same. It is stated that in the pending appeal, the petitioner's name was not included when the order dated 03.02.2026 in W.P.Crl.(MD) No.530 of 2026 was passed and that the petitioner's name has been included only recently. The said contention is recorded.

4. Therefore, the first respondent is directed to dispose of the appeal dated 24.01.2019 within a period of 8 weeks from the date of receipt of a copy of this order. Until then, the earlier order passed by this Court in Page No. 3 of 5

W.P.Crl.(MD) No.530 of 2026 dated 03.02.2026 shall be kept in abeyance. After disposal of the said appeal, the second respondent shall take a decision on the earlier direction. Based on the outcome of the appeal, the second respondent shall pass appropriate orders.

5. With this direction, the present Writ Petition is disposed of. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
