(Crime No. 271 of 2025 )

...Respondent

For Petitioner : Mr.P.Praveenkumar Advocate.

For Respondent : Mr.N.Balasubramanian Counsel for State of TN (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Cr.No. 271 of 2025 on the file of the respondent police.

ORDER : The Court made the following order :- 1/6

The petitioner, who apprehends arrest at the hands of the respondent for the offences punishable under Sections 126(2), 296(b), 132 and 351(2) of BNS, 2023 in Crime No. 271 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant is a Revenue Inspector. As per the order of this Court, when the defacto complainant, along with his subordinates, was surveying the subject land, the petitioner and other accused restrained them from performing their official duty and abused them in filthy language and also made criminal intimidation. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he is no way connected in the above said incident. He has not committed any offence as alleged by the prosecution. He would further submit that coaccused were granted bail. Hence, he prayed to grant Anticipatory Bail to the petitioner.

4. The learned Counsel for State of TN (Crl.Side) would submit that based on the complaint given by the defacto complainant, a case has been registered for the offences punishable under Sections 126(2), 296(b), 132 and 351(2) of BNS, 2023 in Crime No. 271 of 2025. He would further submit that nobody was injured in this case and the petitioner has no previous case. He would further submit that the investigation is pending and the offences are grave in nature and hence, he opposed to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the rival submissions made on either side and the nature of offences charged against the petitioner, and considering the facts that nobody was injured in this case and the petitioner has no previous case and also co-accused were granted bail, I am inclined to grant anticipatory bail to the petitioner, subject to the following conditions:

[a] Accordingly, the petitioner is ordered to be released 3/6
