PRAYER : Criminal Original Petition filed under Section 482 Cr.P.C, to direct the respondent Nos: 4 and 5 not to harass the petitioner and his family members in guise of any enquiry without any complaints or summons or reasons against the petitioner and failed to follow the D.K.Basu Guidelines issued by the Hon'ble Apex Court. This petition has been filed for restraining the respondents from harassing the petitioner in the guise of enquiry.

2. When the matter was taken up for hearing, the instructing police official informed the Court that as on date, the petitioner is not figuring as an accused in any case. Therefore, the question of summoning the petitioner does not arise at all. If at all the respondents 3 to 5 want to enquire the petitioner, they will have to issue summons in writing. The petitioner shall not be orally summoned.
