PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents 4, 7 and 8 to abandon the construction of dividing wall or any other construction activities in the Nangamozhi Regulator in Sadayaneri Channel in Nangaimozhi village in Udangudi Panchayat Union, Tiruchendur Taluk and subsequently direct the respondent No.6 to clean and restore Sadayaneri Channel pending disposal of the main Writ Petition.

ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) This Writ Petition has been filed seeking a direction to the respondents 4, 7, and 8 to abandon the construction of a dividing wall or any other construction activity in the Nangamozhi Regulator in Sadayaneri Channel at Nangaimozhi Village, Udangudi Panchayat Union, Tiruchendur Taluk, and consequently to direct the sixth respondent to clean and restore the Sadayaneri Channel, pending disposal of the main Writ Petition. 3/6

2.When the matter was taken up for hearing today, the learned Special Government Pleader appearing for respondents 1 to 7 and 9, on instructions, submitted that the proposed construction of the dividing wall in the channel had already been dropped at the initial stage and that no construction activity is presently taking place. It was further submitted that water is being supplied through the existing channel and, therefore, nothing survives for adjudication in the present Writ Petition.

3.Recording the said submission, this Writ Petition is dismissed as infructuous. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
