PRAYER: Criminal Revision Case filed under Section 397 and 401 Cr.P.C. praying to call for the records pertaining to order passed in Cr.M.P.No.2245-A of 2021 on the file of District Munsif cum Judicial Magistrate, Alangudi and to set aside the same. ORDER

This Criminal Revision Case has been filed challenging the order passed by the learned District Munsif cum Judicial Magistrate, Alangudi in Cr.M.P.No.2245-A of 2021, dated 03.05.2021, thereby dismissing the complaint filed by the petitioner for direction under Section 156(3) of Cr.P.C.

2. On perusal of the complaint, it revealed that the second respondent set fire to his garbage in the the petitioner's patta land, thereby, the trees located in the said land were damaged and when the same was questioned by the petitioner, the second respondent assaulted her and threatened to kill her. On the complaint lodged by the petitioner, the first respondent conducted enquiry and physical inspection and found that no such occurrence was taken place and as such, the complaint was closed.

3. That apart, it seems that there is a civil dispute between the petitioner and the second respondent in respect of their respective plots. Therefore, the Court below rightly dismissed the petition and this Court finds no infirmity or illegality in the order passed by the Court below.

4. Accordingly, this Criminal Revision Case is dismissed.
