PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the first respondent to instruct the second respondent not to harass the petitioner as well as their family members without any legally sustainable complaint. For Petitioner : Mr.D.Balamurugapandi For R1 and R2 : Mr.K.Suyambulinga Bharathi Government Advocate (Crl.Side)

ORDER

This petition has been filed to direct the second respondent not to harass the petitioner.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the official respondents. Considering the nature of the order going to be passed in this petition, notice to the private respondents herein is dispensed with.

3. According to the petitioner there is a civil dispute pending between the petitioner and the third and fourth respondents herein. https://hcservices.ecourts.gov.in/hcservices/ 1/4

Crl.O.P.(MD)No.11779 of 2019 The petitioner has also filed a suit and the same is pending in O.S.No.132 of 2019 on the file of the Principal District Civil Court, Ambasamudram. Now pending civil suit, based on the complaint given by the third and fourth respondents, the second respondent police is harassing the petitioner to vacate the premises. Hence, the present complaint has been filed.

4. Today, when the matter was taken up for hearing, the learned Government Advocate (Crl.Side) appearing for the respondents, on instructions, would submit that on the complaint given by the third and fourth respondents, enquiry has been conducted and since the enquiry reveals that it is only a civil dispute between the parties, the second respondent police has closed the complaint. He further submitted that the second police has not harassed the petitioner.

5. The submission made by the learned Government Advocate (Crl.Side) is recorded. Considering the fact that the complaint has already been enquired into and closed, no further adjudication needs to be entertained in this petition. Accordingly, this Criminal Original Petition is closed.
