PRAYER :- For Bail Crime no.668/2021 on the file of the Respondent Police.

COMMON ORDER : The Court made the following order :- The petitioners/A5, A7 and A11, who were arrested on 10.08.2021

for the offence under Sections 8(c) r/w 20(b)(ii)(C), 25 and 29(1) of NDPS Act and Section 25(1A) of Arms Act, in Crime No.668 of 2021, on the file of the respondent police, seek bail. 2.The case of the prosecution is that the petitioners and others were found in illegal possession of 196 kgs of ganja. Hence, the complaint.

3.Today, when the matters are taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent police would submit that the occurrence had taken place on 13.06.2021, where the petitioners were found in illegal possession of 196 kgs of ganja. Considering the quantity of contraband involved in these cases and as per the circular of Director General of Police, the cases have been transferred to NIBCID and he is not having any instruction from the NIBCID.

4.Considering the facts and circumstances of the cases, the fact that now the cases have been transferred to NIBCID and also the quantity of contraband involved in these cases, this Court is not inclined to grant bail to the petitioners.

5.Accordingly, these Criminal Original Petitions are dismissed. However, the petitioners are at liberty to renew their applications by adding NIBCID as respondent.
