[Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ on hand has been instituted to direct the third respondent to remove the encroachment made by the fourth respondent in Government poramboke land.
2. The learned Additional Government Pleader would submit that patta has been granted by the Tahsildar under the Government Welfare Scheme and it is a scheme for issuance of free patta. However, the eligibility of a person is to be ascertained with reference to Revenue Standing Order 21.

3. If at all free patta has been granted to an ineligible person, the petitioner is at liberty to approach the second respondent viz., the Revenue Divisional Officer, Mellur, Madurai District, who in turn is empowered to conduct an enquiry by affording opportunity to the parties and take a decision and pass orders. Thus, the petitioner is at liberty to approach the second respondent/Revenue Divisional Officer, Mellur, Madurai District with a petition for adjudication of facts and to verify the correctness of free patta granted in favour of the fourth respondent. In the event of receiving any such petition, the second respondent shall dispose of the same as expeditiously as possible.
4. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
