ORDER
Heard the learned Counsel for the petitioner and the learned Central Government Standing Counsel for R1 and the learned Government Advocate(Crl.side) for R4.
2.This Writ Petition is filed to issue a Writ of Mandamus directing the 1st respondent to re-issue passport to the petitioner based on his application dated 10.06.2025 in file no KWTJP1406116.
3.It appears that the petitioner was issued with the passport on 05.06.2016, which was valid upto 04.06.2026. The petitioner is stated to working in Kuwait as an Electrician. It is informed that the Civil ID issued by the State of Kuwait will expire on 20.09.2025. The petitioner requires to renew the passport for a longer period for renewing the Civil ID. Therefore, the petitioner a made an application on 10.06.2025 for re-issuance of the passport, 2/5
which has been now kept pending, in view of the criminal case is pending as against the petitioner in Cr.No.628 of 2023 under Sections 294b, 323, 324 and 342 of IPC and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, and the case is pending against the petitioner before the Judicial Magistrate Court, Nanguneri, in C.C.No.400 of 2024. 4.The law of the subject is clear. Renewal cannot be denied merely because a criminal case is pending as against the petitioner in terms of the decision of the Division Bench of this Court in Regional Passport Officer Vs. Samsudeen Mohamed Salih (W.A.No.902 of 2023, dated 02.06.2023) 5.Several orders have been passed by this Court. Recently, order in W.P. (MD)No.21311 of 2025 was also passed on 05.08.2025 in S.Siluvai Joy Clasoulin Vs. The Union of India and 3 others. Therefore, there shall be a direction to the respondent No.2, to process the passport application of the petitioner and issue the same.
6.However, it is made clear that the petitioner shall appear before the concerned Court as and when the date is fixed for the petitioner appearance. 3/5
7.It is made clear that in case, the petitioner fails to appear on the date fixed for his personal appearance, the respondents are at liberty to take steps to cancel the renewal of the passport and deport the petitioner back to India. 8.Accordingly, this Writ Petition stands disposed of.
