For Respondent : Mr.T.Senthil Kumar, Additional Public Prosecutor PETITION FOR BAIL Under Sec.438 of Cr.P.C PRAYER :- For Bail in Crime No. 64 of 2020 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner, who was arrested on 20.07.2021 for the offence punishable under Section 6 of POSCO Act in Crime No.64 of 2020 on the file of the respondent Police, seeks bail. 2.The case of the prosecution is that the petitioner committed penetrative sexaul assault on the victim girl, who is aged about 4 1⁄2 years. Hence, the case has been registered against the petitioner. 3.The learned counsel appearing for the petitioners would submit that the petitioner is an innocent person and he has been falsely implicated in this case.

4.The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner committed penetrative sexual assault on 4 1⁄2 year old child and the statement https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.14896 of 2021 of the victim under Section 164 Cr.P.C is also recorded. He would further submit that since the petitioner is absconding, the trial could not be proceeded further.

5. Considering the nature of offence and also the fact that the petitioner is absconding, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
