RESPONDENT/RESPONDENT/RESPONDENT Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to grant extension of time for a period of eight weeks to comply the order in Crl.MP.(MD). No.7482 of 2023 in Crl.RC.(MD).No.527 of 2023 dt.18.5.2023 and to deposit the amount a sum of 20 percentage of the cheque amount i.e., Rs.2,00,000/-(Rupees Two lakhs only)before the Principal District and Sessions Court, Thoothukudi. Prayer in CRL RC(MD). 527/ 2023 :
To call for the records pertaining to the Impugned Order in Crl MP No.1658/2023 in C.A No.46/2023 dated 15.03.2023 passed by the Principal District and Session Court, Thoothukudi District in so far as the condition that the Petitioners shall deposit the 20% of Compensation amount within one month from the date of the order" and till the disposal of the instant Criminal Revision Petition.
Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.PINAYGASH I, Advocate for the petitioner, the Court made the following order:- By the order dated 18.05.2023, this Court has passed an order of interim stay on condition with sufficient time. Thereafter, the petitioner filed this petition seeking extension of time to comply with the said conditional order. When the matter was taken up for hearing on earlier two occasions, the learned counsel for the petitioner sought for short accommodation to comply with the order and this Court has also granted the same. Even though, the petitioner has not been complied with the condition.
2. In the said circumstances, this Court finds no reason to grant extension of time for a period of eight weeks to comply with the said conditional order. Hence, this Criminal Miscellaneous Petition is dismissed. Consequently, the interim stay passed in Crl.MP(MD)No.7482 of 2023 in Crl.RC(MD)No.527 of 2023, dated 18.05.223, is also vacated.
