ORDER : The Court made the following order :- The petitioner/Accused No.1, apprehending arrest at the hands of the respondent Police f or the alleged offence punishable under Sections 498(A), 294(b), 323 and 506(ii) I.P.C, in Crime No.3 of 2023 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant was married to the first accused in 2010. After that they begotten two children. But however, the first accused namely husband developed illegal intimacy with the second accused, that was witnessed by the defacto complainant directly, when that was objected and enquired by her, she was abused and harassed. On 15.06.2023, in a drunken mode, the first accused came to the house, poured kerosene on the defacto complainant and she was immediately taken to the hospital, where she was admitted for three days. After that the present complaint has been registered.

3. The learned counsel for the petitioner submitted that after three days of the occurrence, the above said complaint has been given. The petitioner is an innocent and due to family dispute, the defacto complainant made a false complaint against 2/4

the petitioner before the respondent Police.

4. The learned Government Advocate (Crl. Side) would submit that the bruttal attack has been made by the petitioner upon the defacto complainant. Hence, he makes serious objection to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of this case and considering the grievous allegations made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this anticipatory bail petition deserves dismissal and accordingly dismissed.
