Criminal Original Petition filed under section 482 of Criminal Procedure Code, to transfer the investigation Agency in this case from Kanyakumari District to adjacent District within the time stipulated as fixed by this Honourable Court . This petition has been filed to to transfer the investigation Agency in this case from Kanyakumari District to adjacent District.
2. The learned Government Advocate(Crl.side) would submit that initially a case was registered in Crime No.12 of 2018 for the offences under Sections 294(b),323 and 379 of IPC and after investigation the respondent police has filed final report under Sections 294(b) and 323 of IPC deducting the offence under Section 379 of IPC.
3. Considering the submission made by the learned Additional Public Prosecutor, this Court is not inclined to quash the FIR. However, the respondent police is directed to complete the investigation and file final report before the concerned Magistrate, within a period of four weeks from the date of receipt of a copy of this Order.
