For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Anticipatory Bail in C.C.No.147/2010 on the file of the Judicial Magistrate No.II, Ramanthapuram.

ORDER : The Court made the following order :- The petitioners, who are arrayed as A1 to A4, apprehending arrest at the hands of the respondent police in C.C.No.147 of 2010 on the file of the learned Judicial Magistrate No.II, Ramanathapuram for the offences punishable under Clause 6(4) of TNSC (RDCS) Order r.w. Section 7(1)(a)(ii) of EC Act, seek anticipatory bail. 2.The petitioners were absent during the trial in C.C.No.147 of 2010 on the file of the learned Judicial Magistrate No.II, Ramanathapuram. Therefore, Non-Bailable Warrant came to be issued . 3.The learned counsel appearing for the petitioners undertakes that the petitioners shall appear before the Court below regularly on all future hearing dates without fail.

4.Considering the undertaking given by the petitioners, the petitioners are directed to appear before the learned Judicial Magistrate No.II, Ramanathapuram, within a period of two weeks from the date of receipt of copy of this order and to file a petition to https://hcservices.ecourts.gov.in/hcservices/

recall the NBW issued against him. The concerned Magistrate is directed to consider the same on merits and pass orders on the same day. It is made clear that the Court concerned is directed to consider the recall petition depends upon the gravity of the offence and also how long NBW is pending.
