O R D E R

This Criminal Original Petition has been filed to quash the First Information Report in Crime No.1 of 2016 on the file of the 1st respondent pending investigation 2.The learned Counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Without any base, the first respondent police registered a case in Crime No.1 of 2013 for the offences under Sections 406, 408, 471, 477A read with 34 of IPC, as against the petitioner. Hence she prayed to quash the same.

The learned Government Advocate (criminal side) would submit that there are specific allegations as against the petitioner to attract the offence under Sections 406, 408, 471, 477A read with 34 of IPC. He would further submit that the investigation is almost completed and the respondent police have https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.197 of 2018 only to file final report. Therefore, he prayed to dismiss this petition.

4. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (criminal side) appearing for the first respondent.

5. It is seen from the First Information Report there are specific averments to attract the offences as against the petitioner. Considering the above fact that the investigation is almost over, this Court cannot quash the First Information Report at this stage. However, the respondent police is directed to complete the investigation and file the final report within a period of four weeks from the date of receipt of a copy of this order.

6. With the above observations, this Criminal Original Petition stands dismissed. Consequently, connected miscellaneous petition is closed.
