Petitions filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondent to consider the petitioners representation dated 03.10.2015 on pursuance to the interview conducted on 12.08.2015 and 13.08.2015 and thereby directing the respondents to issue an appointment order to the petitioners in the post of cook into the Adi-Dravidar Welfare Hostel in and around of Tiruchirappalli District through speaking order.
For Petitioner in WP(MD)Nos.3706,3707, 3710 & 3711: Mr.R.Senthilkumar For Petitioner in WP(MD)Nos.3709 & 3717 :M/S.P.A.CHITRAMANI For Respondents : Mr.M.Murugan, Government Advocate in all WPs COMMON ORDER The petitioners have come up with the above writ petitions seeking for the issue of a writ of mandamus to direct the respondents to issue appointment order pursuant to the interview conducted on 13.08.2015 in the post of cook in the AdiDravidar Welfare Hostel in and around Tiruchirappalli District by considering their representations dated 03.10.2015. 2.Since the issue involved in all these writ petitions are one and the same, they are taken up together for final disposal. 3.Heard the learned counsel appearing for the petitioners and Mr.M.Murugan, learned Government Advocate, who takes notice on behalf of the respondents.
4.Admittedly, all of them belong to scheduled caste community and attended interview pursuant to the interview held on 13.08.2015 along with relevant documents. As the petitioners herein did not receive any response from the respondents after the interview, they have filed writ petition in W.P(MD)No.18367 of 2016 which has been subsequently withdrawn by them. Now, the petitioners have individually and independently filed the above said writ petitions seeking for the above said relief. 5.Mr.M.Murugan, learned Government Advocate appearing for the respondents submitted that there were totally 60 vacancies which were exclusively meant for scheduled caste candidates. Out of them, 58 posts have been filled up and the persons who have selected were joined in their respective places. It is further submitted that two posts are vacant namely, one post reserved under the ex-servicemen quota and one post due to non joining of selected candidate under the women category.
6.In view of the above, the respondents are directed to consider the representations of the petitioners dated 13.08.2015 and pass appropriate orders on merits and in accordance with law. However, if the petitioners are not eligible to be appointed, the same shall be communicated to them. The above said exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order.
