O RDER This petition is filed seeking for a direction to the respondent No.2 police to complete the investigation and to file the final report in Crime No.489 of 2022 dated 23.11.2022 2.It is submitted by the learned counsel for the petitioner that on a complaint given by the petitioner/defacto complainant, who is the son of the deceased, in respect of the death of his mother, a case has been registered in Crime No.489 of 2022 for the offences punishable under Sections 294(b) and 306 IPC. Though the FIR has been registered on 23.11.2022, there is no substantial progress in the investigation.
3.The learned Government Advocate (Crl.side) on the other hand submits that the Investigating Officer has sent the suicide note of the deceased to the handwriting expert and the report is awaited. It is also submitted that except getting the report from the Forensic Science Laboratory, rest of the investigation is over and has undertaken that soon after the receipt of the report, the police 2/5
would file the report under Section 173 Cr.P.C., in the Court. The same is recorded.
4.In the meanwhile, Mr.Jerin Mathew, learned counsel has intervened on behalf of the accused, who is not a party in this petition and submitted that the police have completed the investigation and that the deceased has committed a suicide by jumping from the building in the presence of the police personal when the accused was about to take the possession of the property. 5.Considering the circumstances, as the learned Government Advocate (Crl.side) has undertaken that the police will file the charge sheet soon after the receipt of the report from the Forensic Science Laboratory, no further orders are required to be passed.
