PRAYER :- For Bail in Crime No.225 of 2023 on the file of the respondent Police. ORDER : The Court made the following order :- The petitioner/Sole accused, who was arrested and remanded to judicial custody 1/4

on 22.05.2023 for the offence punishable under Section 302 of IPC, in crime No.225 of 2023 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the defacto complainant is the mother of the deceased. The deceased is the married women having two children and she was having illegal affair with the petitioner. The deceased's husband as well as the defacto complainant came to know about the illegal affair, warned the deceased and on request of the deceased's husband, the defacto complainant took her daughter to their home. On 22.05.2023, the petitioner said to have come to her house and with permission of the defacto complaiannt and her family members, he took the deceased with him in two wheeler. Later, the defacto complainant came to know that the petitioner stabbed her daughter with knife and caused death to her. Hence the case.

3. Heard both sides and perused the materials available on record including the First Information Report.

4. There is illegal intimacy between the deceased and the petitioner. On the particular date, this petitioner alleged to have taken the deceased, but in the mid way, he assaulted her discriminately with knife.

5. Considering the fact that it is the case of circumstantial evidence and considering the manner, in which, the above said offence said to have taken place, if the petitioner is released on bail, he may abscond or may tamper the witness, this 2/4

Court is not inclined to grant bail to the petitioner.

6. Hence the petition stands dismissed.
