No. 2150/2021 and consequentially to direct the 2nd respondent to initiate criminal proceedings against the respondents 6 to 10 for fabricating the forged settlement deed dated 20.04.2021 registered as Doc. No. 2150/2021 on the file of 5th respondent Sub - Registrar Office and to remove the relevant entries from the encumbrance maintained by respondents 4 and 5 based on the petitioner's representations dated 11.07.2022 and 18.07.2022 within the time frame as fixed by this Court.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the 2nd respondent to conduct an enquiry under Section 83 of Registration Act, with regard to the fraudulent registration of settlement deed dated 20.04.2021 registered as Doc. No. 2150/2021 and consequentially to direct the 2nd respondent to initiate criminal proceedings against the respondents 6 to 10 for fabricating the forged settlement deed dated 20.04.2021 registered as Doc. No. 2150/2021 on the file of 5th respondent Sub - Registrar Office and to remove the relevant entries from the encumbrance maintained by respondents 4 and 5 based on the petitioner's representations dated 11.07.2022 and 18.07.2022 within the time frame as fixed by this Court.

2.The petitioner has already filed W.P.(MD)No.20503 of 2025 and this Court, vide order, dated 23.08.2023, has recorded the submission of the learned Special Government Pleader that the enquiry was already conducted and the decision is yet to be taken. Therefore, the Court directed the 3rd respondent to take decision based on the petitioner's application within a period of four weeks. 3.The learned Counsel appearing for the petitioner submitted that the respondents failed to take decision till now. 4.Therefore, this Court is directing the 3rd respondent to conduct a fresh enquiry and pass orders strictly within a period of four weeks from the date of receipt of a copy of this order.

5.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
