Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records on the file of the 2nd respondent in connection with the impugned final notices issued by his vide his proceedings in Na.Ka.No.0082/2020/A2 dated 25.07.2022 and quash the both as illegal, arbitrary and thereby direct him to indemnify the loss incurred by the petitioner during Covid - 19 pandemic by way of waving the lease amount for the lockdown period or by extending the license period in regard to collection of toll fee in the weekly market of the 2nd respondent municipality in the light of the order passed by this Court in a 1/4

similar case in W.P.(MD)No.1439 of 2021 dated 29.01.2021 within the time limit that may be stipulated by this Court.

ORDER

The learned counsel for the petitioner seeks permission of this Court to withdraw this writ petition with liberty to file a fresh writ petition on the same cause of action because his request has been rejected vide order dated 08.08.2022 and also made an endorsement to that effect. 2.With the aforesaid liberty to the writ petitioner, the writ petition is dismissed as withdrawn. No costs. Consequently, connected miscellaneous petitions are closed.
