ORDER

The petitioner has filed this petition, challenging the notice issued by the first respondent, namely, the Second Class Executive Magistrate and Thasildar, Paramakudi, Ramanathapuram District, under Section 129 of BNSS.

2. When this petition is taken up for hearing, the learned counsel for the petitioner seeks for a short accommodation.

3. The learned Government Advocate (Crl. Side) submits that the petitioner is a history sheeted rowdy having five previous cases to his credit, out of which, three cases are pending in trial. Therefore, in order to ensure that the petitioner is maintaining the peace, the 1st respondent/the Second Class Executive Magistrate and Thasildar, Paramakudi, Ramanathapuram District, has issued a show cause notice under Section 129 of BNSS.

4. Since it is only a show cause notice, the petitioner can very well appear before the 1st respondent and assure that he is not disturbing the peace. The 1st respondent/The Second Class Executive Magistrate and 2/4

Thasildar, Paramakudi, Ramanathapuram District, can take a call depending upon the reply of the petitioner. At the stage of show cause notice, this Court is not inclined to interfere with the same. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed.
