ORDER

This writ petition has been filed for a Mandamus to direct the first respondent to issue passport based on the petitioner's Application File No. MD01C5028449522 by considering his representation, dated 23.06.2025.

2. It is noticed that the petitioner has been arrayed as an accused in an FIR registered against him in Crime No.452 of 2014, dated 24.07.2014 for offences under Sections 294 (b), 323, 506 (ii) of the IPC and Section 4 of the TN Prohibition of Harassment of Women Act, 2002.

The learned counsel for the petitioner further submits that the name of the accused in the FIR in Crime No.452 of 2014 is Saravanan @ Karuppiah and therefore, the petitioner is not an accused in the said FIR. However, the second respondent confirms that the name of the father of the accused in the FIR is that of the name of the father of the petitioner. The second respondent may there have same suitably altered.

4. The learned Government Advocate for the second respondent submits that although the FIR was registered. It is submitted that the charge sheet was prepared as early as on 09.08.2014. However, it has not been filed so far.

5. Considering the fact that no criminal case is pending before any Court, there can be no impediment in directing the first respondent to issue passport to the petitioner pursuant to the application, dated 27.04.2022 and representation, dated 23.06.2025.

6. Therefore, this exercise shall be completed by the first respondent within a period of 4 weeks from the date of receipt of a copy of this order. In case, by the time, a charge sheet is filed and taken on record by the concerned Court, it is the duty of the second respondent to inform the first respondent for direct transmission of passport to the concerned Court, in which case, it will be open to the petitioner to file a suitable application for retrieving the same from the Court.

6. The writ petition stands disposed of. There shall be no order as to costs.
