Prayer: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus, directing the 2nd Respondent not to register any partition deed or any other document presented by the 3rd Respondent or any other person in respect of the properties comprised in Survey Nos. 739/2, 740, 741, and 752, South Sankarankovil Village, Tenkasi District based on the petitioner representation dated 01-06-2026 and thus render justice.

ORDER

The present writ petition has been filed for the following relief:- "Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus, directing the 2nd Respondent not to register any partition deed or any other document presented by the 3rd Respondent or any other person in respect of the properties comprised in Survey Nos. 739/2, 740, 741, and 752, South Sankarankovil Village, Tenkasi District based on the petitioner representation dated 01-06-2026 and thus render justice."

2. Heard M/s.Santhanamari, learned counsel appearing for the petitioner and M/s.P.Sudarkodi Nachiar, learned Government Standing Counsel, who takes notice on behalf of the respondents 1 and 2.

3. In view of the nature of the relief proposed to be granted, the writ petition is disposed of at the admission stage without issuing notice to the 3rd respondent. This Court is not expressing any opinion on the merits of the matter.

4. The grievance of the petitioner is that she is also one of the legal heirs entitled to a share in the subject property. However, according to the petitioner, the 3rd respondent, after obtaining patta in his favour, is attempting to deal with the property to the exclusion of the petitioner. In such circumstances, the petitioner has submitted objections before the 2nd respondent and has, therefore, approached this Court.

5. If the petitioner seeks to restrain any person from presenting a document for registration, she has to approach the competent Civil Court and obtain appropriate relief. Insofar as the objections submitted before the Sub-Registrar are concerned, the same shall be kept on file. As and when any document relating to the subject property is presented for registration, the Sub-Registrar shall consider the petitioner's

objections in the manner known to law, after issuing notice to the executant, the claimant, and the petitioner. Even if any document has already been presented and is pending registration, the objections of the petitioner shall be considered in accordance with law before appropriate orders are passed.

6. With the above observations and liberty, the writ petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
