Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Certioraraified Mandamus, to call for the records pertaining to the Impugned Order in TCO: DP:O:20:204:2008-09 dated 11/11/2008 on the file of the Respondent No. 4 and the subsequent order of the appellate authority in Ref:Co/VIG/APP/3071/TRY/2009-10 dated 30/10/2009 on the file of the Respondent No. 3 and the order of the Reviewing Authority in 170/REV:TRY:VG:2010-11 dated 12/08/2010 on the file of the Respondent No. 2 and quash the same as illegal and consequently to direct the Respondents No. 1-4 to direct to provide all the consequential service benefits and other costs and charges to the petitioner .
ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.T. LAJAPATHI ROY, Advocate for the petitioner, the court made the following order:- [Order of the Court made by S.S.SUNDAR, J.] This petition is filed to condone the delay of 469 days in representing the above appeal. 2.Heard Mr.T.Lajapathi Roy, learned Counsel for the petitioner. 3.Though the petitioner has stated sufficient reasons for the delay, this Court is of the view that the delay could have been avoided, if due diligence is shown by the petitioner. Hence, this Court is inclined to allow this petition, however, on terms. Accordingly, this petition is allowed and the delay is condoned on condition that the petitioner pays a sum of Rs.
1,000/- to the Legal Services Committee attached to this Bench within a period of three weeks from the date of receipt of a copy of this order, failing which, this petition shall stand automatically dismissed without further reference to Court. Registry is directed to number the above appeal, if the papers are otherwise in order and upon showing the proof for payment.
