ORDER

This writ petition has been filed to forbear the respondents 1 and 2 from granting license to the third respondent to establish the Fireworks factory in Survey Numbers, 317, 319, 321 and 330 In Endapuli Village, Virudhunagar District which comes under the radius of 300 meters from the petitioner's existing quarry in Survey No.333/1.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

The learned counsel appearing for the third respondent would submit that the third respondent's application seeking to establish the fire works factory in Survey Numbers, 317, 319, 321 and 330 In Endapuli Village, Virudhunagar District was considered and licence was granted. Therefore, the prayer sought for in this writ petition has become infructuous

4. Recording the submission, the writ petition is dismissed as infructuous. However, the petitioner is at liberty to challenge the 2/4

licence issued in favour of the third respondent in the manner known to law, if so advised. No costs. Consequently, connected miscellaneous petition is closed.
