PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 4 to remove the encroachment by demolishing the asbestos shed illegally constructed by the private respondent Nos.5 to 9 on the Government Poromboke Land comprised in Survey No.847/41 at Mannavarathi Silukkuvarpatti Village, Nilakottai Taluk, Dindigul District on the basis of the petitioner's representation dated 15.07.2024.

O R D E R
[Order of the Court was made by R.SUBRAMANIAN, J.] This writ petition is filed to issue a Writ of Mandamus, directing the respondents 1 to 4 to remove the encroachment by demolishing the asbestos shed illegally constructed by the private respondent Nos.5 to 9 on the Government Poromboke Land comprised in Survey No.847/41 at Mannavarathi Silukkuvarpatti Village, Nilakottai Taluk, Dindigul District on the basis of the petitioner's representation dated 15.07.2024.
2. The report of the Tahsildar, Nilakottai Taluk, shows that there are encroachments by five persons in the land classified as Government Poromboke (Temple). The nature and the area of
encroachments have also been identified. It is also seen that notices under Section 7 of the Tamil Nadu Land Encroachment Act, 1905, have been issued to the encroachers.
3. Mr.P.T.Thiraviyam, learned Government Advocate appearing for the official respondent would assure the Court that further action will be taken in accordance with law and the encroachments will be removed in the very near future.
4. Recording the statement of the learned Government Advocate and having been satisfied that the action is underway, this writ petition is disposed of with a direction to the official respondents to ensure that all the encroachments have been removed with a period of twelve weeks from today. If the encroachments are not removed, it will be open to the petitioner to seek reopening of the writ petition. No Costs. [R.S.M., J.] [L.V.G., J.] 02.09.2024 NCC :
