PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, directing the second respondent not to harass the petitioner and his family members, based on the petitioner's representation dated 01.06.2023.

For Petitioner : Mr.T.A.Ebanezer For R-1 & R-2 : Mr.B.Thanga Aravindh Government Advocate (Criminal Side) O RDER This Criminal Original Petition is filed seeking for a direction to the respondent Police not to harass the petitioner on the basis of A complaint given by the unofficial respondents. 1/4

It is submitted that respondent Nos.3 and 4 stated to have deposited some money in Jeevan Property Promoters and Jeevan Land Promoters when the petitioner was as one of the employees in the said Company. Subsequently, a case has been registered against one of the Directors of the Company and after completion of investigation, charge sheet has also been filed.

3. It is submitted that the petitioner is no way concerned with the depositing money by unofficial respondents, but the Police have harassed the petitioner, thereby sought for suitable directions.

4. Learned Government Advocate (Criminal Side) submits that respondent Nos.3 and 4 have handed over an amount of Rs.1,51,000/- (Rupees One Lakh and Fifty One Thousand) to the petitioner, who inturn, stated to have deposited money in the said Company. It is submitted that basing on the representation of respondent Nos.3 and 4, an enquiry was conducted, wherein, the petitioner has appeared before the Police and given an undertaking that he would pay a sum of Rs.81,000/- (Rupees Eighty One Thousand only) to respondent Nos.3 and 4 and subsequently, respondent Nos.3 and 4 have withdrawn 2/4

the said complaint. Since then, the respondent Police have never called the petitioner and not been harassed him at all.

Since no petition is pending, learned Government Advocate (Criminal Side) has informed the Court that the Police are not harassing the petitioner and earlier, the petitioner was called to the Police Station only basing on the complaint given by respondent Nos.3 and 4, no further orders are required to be passed in this petition.

6. Accordingly, this Criminal Original Petition stands disposed of. It is needless to say that the respondent Police are directed not to harass the petitioner in respect of civil disputes. 24.07.2023 NCC : Yes/No Index : Yes/No Internet : Yes/No tsg 3/4
