ORDER

The Writ Petition has been filed challenging the impugned refusal check slip dated 16.04.2026 issued by the first respondent.

2. The petitioner presented a document for registration before the first respondent. However, registration was refused on the ground that the parent title deed, namely, Document No.802 of 2015, which is relied upon as the source of title, was not produced at the time of presentation of the document for registration.

3. The learned counsel for the petitioner submitted that the said parent document has been lost and that a complaint in this regard has already been lodged before the second respondent.

4. The learned Government Advocate (Criminal Side), appearing for the second respondent, submitted that the complaint is under enquiry. It is stated that, on an earlier occasion, summons were issued to the petitioner; however, the petitioner was not available at the address furnished in the complaint. It is further

submitted that if the petitioner extends full cooperation, the complaint would be processed in accordance with law and, in the event the document is found to be untraceable, a non-traceable certificate would be issued following the prescribed procedure.

5. In view of the above submissions, this Writ Petition is disposed of on the following terms:

(i) The second respondent shall conduct an enquiry with reference to the petitioner's complaint, in accordance with law, and take all necessary steps to trace the missing document after following the prescribed procedure. In the event the document remains untraceable, a non-traceable certificate shall be issued to the petitioner in accordance with law.

(ii) The aforesaid exercise shall be completed within a period of two months from the date of receipt of a web copy of this order. (iii) Upon issuance of the non-traceable certificate, the petitioner shall be entitled to re-present the document for registration, notwithstanding the impugned refusal check slip, within a period of three weeks from the date of receipt of the said certificate.

(iv) Upon such re-presentation, the first respondent shall entertain and process the document for registration and, if there is no other legal impediment, complete the registration in accordance with law. There shall be no order as to costs.
