O R D E R

This petition has been filed to to direct the 2nd respondent to add Ponnusamy, Murugan, Suresh Murugan and Sudalaiyandi as accused in Crime No.31 of 2018 on the file of the 2nd respondent police.

The learned Government Advocate (criminal side) submitted that the investigation has been completed and the respondent police are yet to file the final report and at this stage, new accused persons cannot be added in this crime number. https://hcservices.ecourts.gov.in/hcservices/ 3.Considering the said submission, this Court is of the view 1/2

CRL.O.P (MD) No.3971 of 2018 that the prayer sought for by the petitioner cannot be granted and the criminal original petition is liable to be dismissed. 4.Accordingly, this criminal original petition is dismissed. However, the 2nd respondent is directed to complete the investigation and file the final report, within a period of 4 weeks from the date of receipt of a copy of this order. Thereafter, the petitioner is at liberty to invoke the provision under Section 319 of Cr.P.C., before the trial Court to add the proposed accused persons, if there is any incriminating evidence as against them during the trial.
