Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records on the files of 4th respondent leased out the fishing rights in favour of respondents 5 to 8 by way of auction proceedings dated on 03.08.2022 in Panchayath form no. 6 Receipt Nos.304703, 304704, 304705, 304706, 304709, and 304710 respectively by his Tender Notice dated 10.07.2022 insofar as it relates to the Vannan Kulam, Ponmettukuttai, Ayyanaar Koil Kulam, Kaaterikulam, Poomaandikulam, Sudukaattukulam, those are mentioned in Serial Nos. 2, 5, 7, 8, 10, 12 quash the same and consequently forbearing the 4th respondent from auctioning of the lease of fishing rights for the said ponds in future. ORDER

The issue raised in this writ petition is covered by the finding in Writ Petition(MD)No.17419 of 2023. I have quashed the proceedings of the fourth respondent in attempting to bring the fishery rights in the tanks, which vests with the temple for auction. The same reasoning applies to this writ petition also.

2. Accordingly, the impugned auction proceedings dated 03.08.2022 in Panchayath Form No.6 Receipt Nos.304703, 304704, 304705, 304706, 304709, and 304710, respectively, by his Tender Notice dated 10.07.2022 insofar as the Vannan Kulam, Ponmettukuttai, Ayyanaar Koil Kulam, Kaaterikulam, Poomaandikulam, and Sudukaattukulam, which are mentioned in Serial Nos. 2, 5, 7, 8, 10, and 12, are quashed.
