O R D E R
This petition has been filed seeking to direct the respondents 1 & 2 to survey and demarcate the petitioner's property comprised in Survey No.84/6 situated at Neiveli Thenpathi, Thiruvonam Taluk, Thanjavur District and consequently direct the 3rd respondent & 4th respondent to provide adequate police protection at the time of survey and demarcate the petitioner's property by 2/6
considering the petitioner's representation dated 06.05.2026 and 09.06.2026 within the time frame that may be fixed by this Court.
2. The learned counsel for the petitioner submitted that the petitioner claims rights over the property in Survey No. 84/6, located at Neiveli Thenpathi in Thiruvonam Taluk, Thanjavur District. The patta originally stood in the name of the petitioner's father, who passed away on 17.07.2010, leaving behind his three sons Periyasamy, Gopal, and Kannan as his legal heirs. The petitioner is now seeking to have the property surveyed and properly demarcated.
3. Heard the learned counsel appearing for the State/respondents 1 and 2 and the learned Government Advocate (Crl.side) appearing for the respondents 3 and 4.
4. Considering the facts and circumstances of the case, this Court directs the petitioner to produce the legal heirs certificate before the revenue authorities. Thereafter, the 1st respondent to conduct the survey and demarcate the property 3/6
with the assistance of the 2nd respondents after issuing notice to the petitioner as well as legal heirs of Karuppaiah who is the father of the petitioner and the rival claimants if any. If necessary, seek police protection, the 3rd respondent shall provide police protection to survey the land. In case the petitioner seeks to install the boundary stone, the same may be provided at the cost of the petitioner. The Court is also directing the Official respondents to adhere to the following Standard Operating Procedures:
a. The Official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.
b. After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.
c. If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. 4/6
The aforesaid procedure shall be strictly followed by the parties The said exercise shall be completed within a period of 12 weeks from the date of receipt of a copy of this order.
