For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.67 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/accused No.7, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 25(1)(a) of Arms Act,
1959, in Crime No.67 of 2023 on the file of the respondent police, seeks anticipatory bail.
2.The earlier application filed by the petitioner was dismissed by this Court by the order dated 17.05.2023, considering the facts and circumstances of the case the custodial interrogation of the petitioner is required. Now the grievance of the petitioner is that no proper enquiry was undertaken and not even the petitioner was enquired about his involvement. Straight away the FIR has been registered for the offence under Section 25(1)(a) of the Arms Act. 3.The learned Government Advocate (Crl. Side) would submit that this petitioner is hire link with second accused. They wanted to do away the rival group namely Gurusamy and others. For the purpose of killing the above said rival group only the people assembled in the place of occurrence and making conspiracy. On seeing the police party some of the parties escaped from that place. Some of them arrested. On the basis of the confession of the above said persons, the involvement of the petitioner and others came to light. Apart from that it is also seen that the petitioner is having previous cases in Crime NO.347 of 2020, 29 of 2020.
4.Considering the bad antecedents of the petitioner, I find no reason to differ from the view that has been taken earlier. There is no change of circumstances.
