ORDER

This Writ Petition has been filed for a Mandamus to direct the respondents 2 to 4 to consider petitioner's application and issue a Legal Heir Certificate.

The specific case of the petitioner is that the petitioner's husband, who died 04.09.2024, was earlier married one Shanthi/fifth respondent and the marriage solemnized between them was dissolved on 02.12.2006 in H.M.O.P.No. 68 of 2006 on the file of the Sub Court, Trichy. The said order has not been appealed so far.

3. It is further submitted that the petitioner contracted marriage with the said Nataraj on 24.01.2007, through whom, the petitioner has two daughters, namely, Shalini and Bavatharani.

4. It is admitted by the learned counsel for the petitioner that through the first marriage, the petitioner's husband Late.Natarajan with Shanthi, had two children, namely, Priyavatha @ Priya and Prabhu.

5. It is submitted that there is no other dispute and therefore, there is no justification of denial of the Legal Heir Certificate by the third respondent in response to the application filed by the petitioner on 27.03.2025.

6. Since no adverse orders or favourable orders are proposed to be passed, at the time of admission, after hearing the learned counsel for the petitioner and the learned Special Government Pleader for the respondents 1 to 4 and after dispensing with the notice to the respondents 5 to 7, there shall be a direction to the third respondent to consider the petitioner's application dated 27.03.2025, after obtaining a report from the fourth respondent for issuance of Legal Heir Certificate as expeditiously as possible preferably within a period four (4) weeks 3/5

from the date of receipt of a copy of this order.
