For Respondent : Mr.P.Kottai Chamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.1822 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A2 who apprehends arrest at the hands of the respondent Police, for the offence punishable under Sections 294(b), 324 and 506(i) IPC, in Crime No.1822 of 2021, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that on 25.07.2021, at about 6.30 p.m., when the defacto complainant was standing in front of a street, the petitioner along with another accused came there, abused the defacto complainant in filthy language and attacked him and also caused injuries.

3. The learned counsel for the petitioner submits that at the time of occurrence, the petitioner was not present in the place of https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.15173 of 2021 occurrence. However, he has been falsely implicated in this case. He further submits that this is the second anticipatory bail petition. The earlier anticipatory bail petition was dismissed as withdrawn on 16.09.2021. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) submits that the investigation is yet to be completed.

5. Considering the facts and circumstances of the case, the nature of allegations levelled against the petitioner and also the fact that there is no change in circumstances in the case to consider the present petition, this Court is not inclined to grant anticipatory bail to the petitioner.
