RESPONDENT/RESPONDENT/COMPLAINANT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to direct the Learned Judicial Magistrate No. 4, Madurai not to insist the petitioner to produce blood relative as surety for his release in bail order passed by this Hon`ble Court in Crl.O.P.(MD)No. 13082/2021, dated. 09.09.2021.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.G.BHAGAVATHSINGH, Advocate for the petitioner and of MR.RMS.SETHURAMAN, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- This petition has been filed seeking a direction to the learned Judicial Magistrate No.4, Madurai not to insist the petitioner to produce blood relative as surety for his release on bail as per order passed by this Court in Crl.O.P.(MD)No.13082 of 2021.
2. The learned Counsel for the petitioner would submit that the petitioner had furnished the sureties in pursuance of the order passed by this Court in Crl.O.P.(MD)No.13082 of 2021, dated 09.09.2021, however, the learned Judicial Magistrate refused to accept the sureties on the ground that the sureties are not the blood relatives of the petitioner/accused.
3. The learned Additional Public Prosecutor appearing for the respondent would submit that the learned Judicial Magistrate has not returned the papers on the ground that the blood relatives were not produced as sureties.
4. Heard the learned Counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State and also perused the materials placed on record.

5. It is pertinent to mention that this Court has not passed any order directing the petitioner to produce sureties who are related to him by blood. As rightly pointed out by the learned Additional Public Prosecutor, the learned Judicial Magistrate has not returned the papers on the ground that the blood relatives were not produced as sureties, but on the other hand, the learned Judicial Magistrate rejected the sureties as not satisfactory. Therefore, the petitioner is at liberty to produce his sureties to the satisfaction of the learned Judicial Magistrate. It is clarified that this Court has not passed any order directing the petitioner to produce sureties who are related to the petitioner by blood.
6. With the above observations, this Criminal Miscellaneous Petition is disposed of.
