This petition has been filed to set aside the order passed in Cr.M.P.No.3875 of 2016 in C.C.No.38 of 2009, dated 28.11.2016 on the file of the learned Judicial Magistrate No.I, Virudhunagar, by allowing this Criminal Original Petition and to permit the petitioner / accused to recall PW.1, 2 , 3 , 4 & 6 for the purpose of cross examination.

2. The learned Government Advocate (Crl.Side) appearing for the respondent would submit that the case in C.C.No.38 of 2009 on the file of the learned Judicial Magistrate No.I, Virudhunagar, has been ended in conviction and nothing survives in this petition.
