ORDER

The petitioner seeks for a Mandamus directing the respondents to restore and reconstruct the drainage canal in the east west street of this petitioner's house with door No.62, by connecting this house drainage system into public drainage system, by removing the obstructions and by forming connecting canal.

2. Mr.K.Mahesh Raja, learned Government Advocate takes notice for the respondents 1 and 2 and Mr.K.P.Krishnadass, learned Government Advocate takes notice for the respondents 3 and 4.

3. By consent, the writ petition itself is taken up for final disposal.

4. After some elaborate arguments, the learned counsel appearing on behalf of the petitioner submitted that it would suffice if the representation of the petitioner is disposed of, on merits and in accordance with law, within a time frame to be fixed by this Court.

5. In view of the limited scope of the prayer, without expressing any opinion on the merits of the issue involved, since the petitioner has made representation to the respondents 1 and 2, who in turn forwarded the same to the 3rd respondent, the 3rd respondent is directed to pass appropriate orders on the representation of the petitioner dated 30.07.2013 on merits and in accordance with law, after giving notice to the interested parties, if any, within a period of four months from the date of receipt of a copy of this order. This order should not be construed as giving any positive direction to the 3rd respondent and the 3rd respondent shall pass orders, independently, depending on the facts and circumstances of the case.

6. With the above direction, this Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
